The Commission released its proposal for a regulation on AI in April 2021. The regulation proposal leaves open how much national discretion it would allow. The aim of the proposal is to regulate a limited set of AI system use cases, and the majority of AI system use would be permitted. Nevertheless, the scope is quite broad. One can ask whether such comprehensive and complex regulation is necessary and in line with the EU law principle of proportionality.
